The mutual acceptance and Consideration. Consideration is a legal term for something of value. Typically one side pays money for goods or services. A part of the test is the money, while the other is the good or service. Mutual consent is the understanding of both parties as to what the agreement involves. Generally, the mutual consent is manifested by a signature, however, in an oral contract such as when one buys something from a fast food restaurant, by the mutual consent implicit in the actions and words of the parties.
