If you are talking about your insurance company, probably not because they, as a rule, the insurance company to get subrogation rights in exchange for a fee. In insurance company can certainly sue, but it is not always the case. OTOH, if your sure to make the payment, and then, absolutely not, if your insurance company is incompetent. Insurers always do the plaintiffs to abandon it in the future all legal remedies arising out of this claim before paying. Demand is considered resolved in full.
