Can earned income be taken from the spouse that does not owe child support?

No. Only the biological parents responsible for the financial support of their minor children. Please, keep in mind that even though it is not compulsory of the spouses can not be considered directland responsible for child support obligations, in most cases, joint bank accounts can be levied or joint property may be encumbered by a right of retention if there are support arrears. That being the case, the non-obligatory spouse is likely to be affected by a judgment.
